WHAT IS TITLE IX?
Title IX is a landmark federal civil rights law that prohibits sex discrimination in education. Title IX is not just about sports; it is a prohibition against sex-based discrimination in all educational or school-sponsored programs. Title IX does not apply to female students only. Title IX protects any person from sex-based discrimination. Female, male, transgender, and gender non-conforming students, faculty, and staff are protected from any sex-based discrimination, harassment or violence.
Title IX covers discrimination against pregnant and parenting students and women in STEM (science, technology, engineering, and math) programs. Title IX also covers sexual harassment, gender-based discrimination, and sexual violence. Sexual violence includes attempted or completed rape or sexual assault, as well as sexual harassment, stalking, voyeurism, exhibitionism, verbal or physical sexuality-based threats or abuse, and intimate partner violence.
Title IX states, "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Financial assistance." 20 U.S.C. § 1681 & 34 C.F.R. Part 106 (1972)
The U.S. Department of Education’s Office for Civil Rights (OCR) is the division of the federal government charged with enforcing compliance with Title IX. Information regarding OCR can be found on OCR's website.
Kaua`i Community College's Commitment to Title IX
All members of the Kaua`i Community College community, guests, and visitors have the right to be free from all forms of sex/gender harassment, discrimination, and misconduct, examples of which can include acts of sexual violence, sexual harassment, domestic violence, dating violence, and stalking. All members of the campus community are expected to conduct themselves in a manner that does not infringe upon the rights of others.
Nondiscrimination Under Title IX
Kaua`i Community College does not discriminate on the basis of sex in any educational program or activity in which it operates and is required by Title IX and its implementing regulations not to discriminate in such a manner. Kaua`i Community College’s prohibition of discrimination in educational programs and activities extends to employment as well as to admission.
